Australia’s system of Family Law for the dissolution of marriage, or divorce, is a no-fault system, meaning neither spouse needs to prove ‘fault’ or marital misconduct on the part of the other. However, before a divorce is granted, several factors must be considered to ensure there are no complications. In divorce proceedings, the two grounds to demonstrate to the Family Court are:
- Irretrievable breakdown of marriage with no prospects of reconciliation; and
- The parties have separated for at least 12 months.
If a couple with children separates, they can jointly create an informal parenting arrangement for child support and child custody, or the Court may formalise an agreement between parents as Consent Orders. Property settlement is equally important, and it’s best to address the division of property as early as possible.
